Home birth is legal in all 50 states – it is not illegal to have a home birth in Nebraska! However, the legal landscape surrounding professional birth assistance is complex and restrictive. At this time it is a felony for Certified Nurse-Midwives (CNMs) to attend home births in Nebraska, creating a significant barrier for families seeking professional medical support during home deliveries.

The current Nebraska law requires certified nurse midwives to practice only in licensed healthcare facilities, primary offices of licensed practitioners, or organized public health agencies. This means that the most highly trained midwives cannot legally attend home births, leaving families with limited options for professional assistance.
